Our Role

We serve exclusively as a referral and booking facilitation platform that connects customers with independent equipment owners and service providers in the Destin, Florida area. Our role is limited to:

• Providing a platform to display available rental options
• Facilitating booking requests through third-party software
• Receiving affiliate commissions from service providers after completed rentals

Direct Customer-Provider Relationship

By using this website to make a booking, you acknowledge and agree that:

1. You are entering into a direct contractual relationship with the independent equipment owner/operator, not with Original Crab Island
2. All payments are processed directly to the service provider through third-party payment software
3. All rental agreements, terms, conditions, and liability waivers are between you and the service provider
4. The service provider is solely responsible for the condition, safety, operation, and maintenance of all equipment
5. The service provider carries their own liability insurance for their operations and equipment

Limitation of Liability

ORIGINAL CRAB ISLAND EXPRESSLY DISCLAIMS ALL LIABILITY for:

• Personal injury, death, or property damage arising from the use of any rented equipment or services
• The condition, safety, seaworthiness, or airworthiness of any equipment
• The actions, omissions, negligence, or misconduct of any service provider or their employees
• Accidents, incidents, or injuries occurring during any rental activity
• Breach of contract or failure to perform by any service provider
• Cancellations, refunds, or disputes between customers and service providers
• Weather-related cancellations or changes to bookings
• Loss or damage to personal property during rental activities

Assumption of Risk

Water sports, parasailing, boating, and related activities involve inherent risks including but not limited to drowning, collision, equipment failure, and serious injury or death. You voluntarily assume all such risks when booking through our platform.

No Warranties

We make NO WARRANTIES OR REPRESENTATIONS regarding:

• The quality, safety, or condition of any equipment
• The qualifications, licensing, or competence of any service provider
• The accuracy of descriptions, photos, or information provided by service providers
• The availability of equipment or services at the time of your booking

Indemnification

By using this website, you agree to indemnify, defend, and hold harmless Original Crab Island, its owners, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of any services booked through this platform.

Independent Contractor Status

All service providers listed on this website are independent contractors. They are not employees, agents, or representatives of Original Crab Island.
